Fair is highly skilled and specialises in all areas of labour law. He has over 20 years’ experience.
His experience includes advising and representing clients in disputes involving unfair dismissal, unfair labour practice, unfair discrimination, collective bargaining and clients with condonation, rescission, interlocutory and review applications in the CCMA, in various Bargaining Councils and in the Labour Courts.
Fair has advised and assisted clients on the disciplinary process, including reviewing and drafting disciplinary codes, policies and procedures and reviewing and drafting disciplinary charges. He has presided over and prosecuted hearings on misconduct, poor work performance, grievances and incapacity. He has also assisted clients with internal investigations into employee conduct in the workplace.
He provides labour related opinions. He specialises in reviewing and drafting employment contracts, independent contractor agreements, and conducting due diligence and labour law compliance related checks and audits.
Fair has worked on issues around labour law consequences related to corporate transactions such as sale of businesses, mergers and acquisitions and share sale agreements. He has advised and assisted clients with the retrenchment process and disputes related to retrenchment.
